Appraisal Contingency

Make sure that you meet the appraiser! Bring a fresh copy of the sales contract, some sales comparisons in the neighborhood. Above all, be friendly and professional. Treat the appraiser like you would treat a prized customer. Make their job as easy as possible, be helpful. Get the appraiser's contact information, and give all of your contact information. Ask the appraiser to call you if there is a problem with the appraisal. In three or four days, call the appraiser to see how it is going.

If you've done everything you possibly can, and the appraisal falls short of the sales price, under a standard appraisal rider, the buyer has to deliver the full appraisal to the seller within five days. If the seller chooses not to reduce the sales price to the appraised amount, the buyer may terminate the contract, or choose to bring more cash to the closing table. More importantly, if the buyer does not provide the appraisal before the loan commitment date, the contingency is waived, and the contract moves forward.

Under the terms of an FHA rider, the appraiser may predicate any suspected defects on the house. If an appraiser predicates the property, buyer and seller have ten days to have an inspection performed and agree upon who will pay for any repairs as needed. An FHA purchaser's earnest money will enjoy additional protections under the terms of an FHA rider, but as always, as the buyer's agent, make sure that all dates are observed religiously.

VA riders afford similar protections to the buyer in terms of earnest money and predication work. That said, do not expect to rely on the VA rider to protect your buyer should they not observe the terms of the contract. Keep them on target, and all will be well.
