Title and Survey Contingency
First of all, cut down on your steps. Have your buyer sign a Title and Survey Work Order at a time when you are already meeting. The building inspection is a great time to do this. The sooner you get this off to the title company, the better. Always recommend a stake survey, the spot survey is a simple drawing that is completely worthless to your buyer. Only a current stake survey is useful and will give your buyer survey coverage.
One of the major differences between the Residential Sales Contract and the Special Sales Contract is that a Special Sales Contract only calls for a special warranty deed, not a general warranty deed. The special warranty deed only guarantees that the current owner has the legal right to sell the property, but only provides for the seller's period of ownership. Liens arising from previous periods of ownership will not be covered.
Intended use is another major provision of the Title and Survey Contingency. Get to know your buyer. If they tell you about their plans to buy a recreational vehicle (after the closing, of course), or they have a lot of pets, or want to raise pigs in the back yard, you need to check the municipal or subdivision restrictions.
It is often better to have your buyer order, provide, and purchase title, even if the seller is being asked to make a contribution toward closing costs, prepaid expenses, and / or points. This puts the buyer (and the buyer's title company) completely in charge of the buyer's title. This will avoid any temptation to cut corners by a seller, and keep the title firmly in the hands of people that you are dealing with directly.
There are a lot of title and survey problems that can come up. If you wait to order the title and survey work, these problems will not appear in a timely manner. There are solutions to almost any title and survey issue, but they will seem much smaller if you have weeks to solve them rather than days or hours!
Don't forget to review the title work when it comes back. Check the seller's name and the property address. Look at the liens and judgements against the property. Sometimes, the closing is so far off, nobody looks over the report. Again, a stitch in time saves nine -- a minor problem with a month before closing will become a major problem with two days to go. If you see something out of the ordinary, bring it to a manager!
Finally, if a title issue pops up, call Buddy right away. Don't try to solve the problem on your own, lean on your broker. He's been there, and he'll get you back on track for a closing.
